REQUIREMENT FOR APPROVAL OF BUILDING PLAN BY THE CANTONMENT BOARD.

1.   Notice under section 235 of the Cantonment Act 2006 in triplicate.

2.   Building plan showing the details on tracing cloth + 2 ammonia  prints.

3.   Latest 7/12 extract.

4.   Valid Non agricultural order/permission from Collector of Nasik.

5.   Latest Non agricultural tax receipt.

6.   Sanctioned lay out copy with sanction letter or copy of map from TILR  Nasik showing the        proposed plot.

7.   Stability certificate with copy of registration from Registered RCC Designer.

8.   No objection certificate for use of approach road (In case of private road)    

9.   Copy of sale deed.

10.  Copy of GPA with signature of Sub-Registrar, Nasik.

11.  All Xerox copies should be attested.

12.  Water arrangement for construction purpose.

13   Undertaking regarding construction work on Rs 50/- Court Fee Stamp Paper, duly         notorised.

14   Undertaking regarding non-claiming the FSI of the area, if the area of the plot is less than         that of mentioned in the 7/12 uttara.

15   Undertaking that the GPA Holder is alive as on date.

16   Undertaking from the owner if the Architect is submitting the building plan on behalf of the         owner.

REQUIREMENT FOR NOC FOR NA PURPOSE BY THE CANTONMENT BOARD.

1.   Application form

2.   Tracing cloth showing the proposed plot for NA purpose alongwith two blue prints

3.   Latest 7/12 Extract

4.   NOC of all the owners as per 7/12 extract.

5.   NOC for approach road

6.   Latest original TILR map or sanctioned layout

7.   Copy of GPAH with signature of Sub-Registrar.

8.   All xerox copies should be attested

PROCEDURE

1    Building Application Sanction

     Building application form to be obtained from the General Clerk.

     Submission of Building application, afterwards payment of scrutiny fee as assessed by the      Sec Engineer, to the Despatcher.

     Building application is forwarded to the Legal Advisor for legal opinion.

     The party is asked to for compliance of queries/observations if any.

     Building application in order is refereed to the Board.

     After sanctioning the building plan by the Board, the party is asked to pay development     charges/ tree deposit/ compound wall process charges, as applicable and thereafter      sanctioned Building plan is released.

     Party to inform the date of commencement of the work.

     Party to take plinth completion certificate for further work.

     If the construction is not found as per sanctioned building plan party to submit the revised      plan as per site situation.

     Party to submit revised building plan if changes are made.

     Party to apply for Ist extension of time to complete the construction, if required, for which  the      application should reach office within a period of one year from the date of release of      building plan sanction or date of commencement,whichever is later.

     Ist extension for one year is considered by the Board

     The party again to apply for IInd extension for one year if required.

     Completion certificate is issued on application by the party after considering the same by      the Board.

2    Unauthorised construction

If any person makes construct of a building without prior permission of the Board, the construction is treated        unauthorised.  During the visit of the officials of the Board if the unauthorised construction is noticed, show cause notice is issued to the party for removal of the same. The matter is referred to the Board for consideration, and thereafter notices under Section 248/320 of the Cantonments Act 2006 are issued to the party. The party to submit the composition building plan for regularisation of the unauthorised construction by the Cantonment Board and if the same is found within bye laws and FSI, the same  is compounded with the approval of the GOC-in-Chief, Southern Command, Pune by charging necessary composition fee as decided by the Board. However, if the construction is not within FSI / or as per building bye laws, the same is required to be removed at the risk and cost of the owner.

3    Encroachment :

During the visit of the officials of the Board the encroachment on Cantonment land (Class C & B-4) /Defence land (excepting Class C & B-4 land), if noticed, the notice under PPE Act is issued to the person(s) concerned in respect of encroachment on Cantonment land and in respect of encroachment on DEO land, the same is informed to the DEO, Mumbai. The parties        concerned are asked to remove the encroachment orelse the same is removed by the Cantonment Board/DEO at the risk and cost of the persons concerned.

4    NOC FOR CONVERSION OF AGRICULTURAL LAND INTO NON
     AGRICULTURE:

The party to submit application for conversion of  agricultural land into non agriculture. The application is forwarded to the Station HQs for their NOC from military point of view. After NOC by the Station HQs, the matter is refereed to the Board for consideration and after approval of the Board the NOC is released with the condition to develop the roads, street lights, water pipeline, sewer lines, parking arrangements and thereafter to submit the final layout for approval of the Cantonment Board.
